Bad Air Day III

Keadaan yang berjerebu di Lembah Kelang membuatkan teman memilih untuk berkurung di kediaman dan meluangkan banyak masa bersama rakan-rakan yang sebelum ini sibuk belaka. Sempat juga berbual dengan muqreez pasal Bad Air Day - keadaan jerebu yang melanda.

Bila Kerajaan isytihar darurat di Pelabuhan Klang dan Kuala Selangor, ianya mengundang diskusi dari pelbagai aspek undang-undang:

1) Adakah Perdana Menteri mempunyai kuasa untuk mengisytiharkan darurat? Bukankah ianya di bawah kuasa Yang di-Pertuan Agong? Malah seperti dilaporkan berita pada 11/08/05, Pak Lah memberi kebenaran mengisytiharkan darurat kepada Bahagian Keselamatan Negara (BKN) dan Jabatan Alam Sekitar (JAS) jika IPU mencecah 500 tanpa mendapatkan kelulusan daripadanya terlebih dahulu.

2) Sejauh manakah penguatkuasaan 'darurat' tersebut? Adakah sama dengan darurat perang? Yang teman pasti, ketika meneliti dokumen Pengisytiharan Darurat Jerebu tercatat bahawa Darurat Jerebu tidak termasuk di dalamnya perintah berkurung.
Beza antara Malaysia dan Indonesia ialah Indonesia mengklasifikasikan darurat kepada Darurat Perang dan Darurat Sivil. Maka kes seumpama di Aceh ketika dilanda tsunami dahulu diklasifikasikan sebagai Darurat Sivil.

3) Bolehkah syarikat-syarikat swasta yang diarah menghentikan operasi ketika Darurat Jerebu ini menyaman Kerajaan Malaysia di atas beban kerugian yang ditanggung sepanjang pemberhentian operasi tersebut?

4) Bolehkah Kerajaan Malaysia mengambil tindakan undang-undang antarabangsa terhadap Kerajaan Indonesia akibat pencemaran jerebu yang berlaku?
Ini persoalan-persoalan menarik yang timbul untuk dibincangkan secara ilmiah. Itu dari aspek undang-undang.

Belum lagi dibincangkan dari aspek sains politik bilamana menjadi kewajipan Kerajaan untuk prihatin terhadap aspek kesihatan rakyat. Selain itu, dari aspek hubungan diplomatik antarabangsa, hubungan di antara Kuala Lumpur dan Jakarta dalam menangani konflik yang timbul berikutan jerebu ini juga menarik untuk diperbincangkan.

Tidak ketinggalan kesan jerebu kepada ekonomi negara. Yang pasti, bursa saham di Bursa Malaysia terus ditutup rendah. Semua ini kesan daripada pemberhentian operasi di Pelabuhan Klang dan beberapa aspek lain lagi yang menggugat keyakinan pelabur di Malaysia buat masa sekarang.

about emergency,yes Agung has the power to declare the emergency but maybe on the practical side, as if like the power has been vested in the hand of executive. lagipun haze is different which needs immediate and hurry action. May be exception to te general rule. FC cannot be read literally otherwise it cause injustice.

lagipun declaration of emergency masa zaman dulu2, is not revoked yet, maksudnya skrg nih malaysia is still in the state of emergency (law sense).

2) regarding international suit against indon, it seems like malaysia (8 companies )also either direct or indiretly involved in this open air burning. kalau dalam negligent,it called contributory negligence, which the liabilities go to the both parties. But in this case i dun know what is called, but still the principle is applied. so no use to lodge te suit

3) can the companies take an action against government for economic loss? i dun think so, coz this is a matter of public policy
